General Terms and Conditions (GTC)<\/strong>

Scope<\/h2>\n

These General Terms and Conditions (GTC), in the version valid at the time of the order, apply exclusively to the business relationship between NUI \u2013 Genossenschaft f\u00fcr Gesundheit und Wohlbefinden eG<\/strong>, Schulgasse 70, 6850 Dornbirn, Austria, represented by the board member Enrico Mandl (hereinafter “NUI”), and the customer. The online shop is aimed exclusively at consumers within the meaning of the Austrian Consumer Protection Act (KSchG). Deviating conditions are not permitted unless NUI has expressly agreed to them.<\/p>\n\n

Conclusion of contract<\/h2>\n

The presentation of goods in the online shop does not constitute a legally binding offer. The customer may place products in the cart without obligation and correct their entries at any time before submitting the binding order. The purchase contract is effectively concluded when the customer clicks the order button. The customer is informed of the receipt of the order by e-mail. The contract language is German.<\/p>\n\n

Delivery<\/h2>\n

NUI bears the shipping risk. If goods are delivered with transport damage, the customer must inform NUI without delay. The delivery time may vary by country and shipping method. In addition to delivery, self-collection at the shop is also possible.<\/p>\n\n

Payment<\/h2>\n

The customer has the payment methods shown during the order process at their disposal (including credit card, PayPal, instant bank transfer via Stripe\/PayPal as well as advance payment). In the case of advance payment, delivery takes place after receipt of payment to the account IBAN AT08 5800 0156 9254 7011, BIC HYPVAT2BXXX. All prices include statutory VAT. Unless otherwise agreed, the customer bears the shipping costs. In the event of default in payment, the customer undertakes to pay reminder charges as well as default interest of 4 % p. a. (consumer transaction, \u00a71000 ABGB); the assertion of further claims remains unaffected.<\/p>\n\n

Retention of title<\/h2>\n

The goods remain the property of NUI until full payment.<\/p>\n\n

Warranty & Liability<\/h2>\n

The statutory warranty law applies. A guarantee only exists if such has been expressly agreed. NUI is liable for injury to life, body and health in accordance with the statutory provisions; otherwise only for damage attributable to intentional or grossly negligent conduct. In the case of slightly negligent breach of essential contractual obligations, liability is limited to the damage typically foreseeable for the contract. Claims under the Product Liability Act remain unaffected.<\/p>\n\n

Online dispute resolution<\/h2>\n

The European Commission provides a platform for online dispute resolution (ODR): https:\/\/ec.europa.eu\/consumers\/odr<\/a>. NUI prefers to resolve concerns directly and is neither obliged nor willing to take part in a dispute resolution procedure before a consumer arbitration board. Contact: hello@nui-vital.com.<\/p>\n\n

Final provisions<\/h2>\n

Austrian law applies exclusively, excluding the conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Dornbirn, Austria; this does not apply to consumers within the meaning of the KSchG, for whom the statutory places of jurisdiction apply. Should any provision of these GTC be invalid, the remaining provisions remain unaffected.<\/p>\n\n
